Alpha News v. Detroit Lakes (Nicole Mitchell Body Cam Case)

Case Attorney: Nicholas Nelson and Allie Howell

What really happened the morning a sitting Minnesota state senator was arrested?

That question is at the center of this case.

On April 26, 2024, the Upper Midwest Law Center filed a lawsuit on behalf of Alpha News seeking the release of body and dash camera footage related to the arrest of Senator Nicole Mitchell in Detroit Lakes.

The arrest—reported to have occurred around 4:45 a.m.—quickly became the subject of public attention and conflicting narratives. Statements made publicly by Senator Mitchell and her attorney appeared to differ from the allegations detailed in the criminal complaint.

With growing public interest and increasing calls for transparency, UMLC filed this action under Minnesota law to make the footage available so the public can see what actually happened.

Why the Case Was Filed

Minnesota law allows courts to authorize the release of law enforcement body camera footage when it serves a public interest.

This case argues that standard clearly applies.

The arrest of a sitting state senator, combined with conflicting public accounts and widespread attention, raises serious questions that cannot be answered without access to the underlying footage.

UMLC is seeking to ensure that the public is not left to rely on competing narratives, but instead has access to the facts.

Case Update

Following the filing of the lawsuit, Senator Nicole Mitchell was found guilty of first-degree burglary and possession of burglary tools after unlawfully entering her stepmother’s home.

Despite the conviction and continued public interest, the court denied access to the requested body camera footage.

UMLC has appealed that decision and continues to pursue the release of the footage to promote transparency and accountability.

Why This Case Matters

This case is about more than one arrest.

It is about whether the public has the right to access critical information, especially when it involves an elected official and conflicting accounts of a high-profile incident.

Transparency builds trust. Without it, questions remain unanswered.

UMLC is working to ensure that the law is applied as intended and that the public has access to the information it deserves.
